What Happens If the Presidential Election Is a Tie

In four instances, the Electoral College, not the popular vote, has determined the outcome of a presidential election. Although there has never been a tie, the U.S. Constitution outlines a process for resolving such a scenario. Heres what would happen and who the players involved are if the 538 electors sit down after the election and vote 269 to 269. The U.S. Constitution When the U.S. first gained its independence, Article II, Section 1 of the Constitution outlined the process for selecting electors and the process by which they would select a president. At the time, electors could vote for two different candidates for president; whoever lost that vote would become vice president. This led to serious controversies in the elections of 1796 and 1800. In response, U.S. Congress ratified the 12th Amendment in 1804. The amendment clarified the process by which electors should vote. More importantly, it described what to do in the event of an electoral tie. The amendment states that the House of Representatives shall choose immediately, by ballot, the President† and â€Å"the Senate shall choose the Vice-President. The process is also used in the event that no candidate wins 270 or more Electoral College votes. The House of Representatives As directed by the 12th Amendment, the 435 members of the House of Representatives must make their first official duty the selection of the next president. Unlike the Electoral College system, where larger population equals more votes, each of the 50 states in the House gets exactly one vote when selecting the president. It is up to the delegation of representatives from each state to decide how their state will cast its one and only vote. Smaller states like Wyoming, Montana, and Vermont, with only one representative, wield as much power as California or New York. The District of Columbia does not get a vote in this process. The first candidate to win the votes of any 26 states is the new president. The 12th Amendment gives the House until the fourth day of March to select a president. The Senate At the same time that the House is selecting the new president, the Senate must select the new vice president. Each of the 100 senators gets one vote, with a simple majority of 51 senators required to select the vice president. Unlike the House, the 12th Amendment places no time limit on the Senates selection of a vice president. If There Is Still a Tie With 50 votes in the House and 100 votes in the Senate, there could still be tie votes for both president and vice president. Under the 12th Amendment, as amended by the 20th Amendment, if the House has failed to select a new president by Jan. 20, the vice president-elect serves as acting president until the deadlock is resolved. In other words, the House keeps voting until the tie is broken. This assumes that the Senate has selected a new vice president. If the Senate has failed to break a 50-50 tie for vice president, the Presidential Succession Act of 1947 specifies that the Speaker of the House will serve as acting president until tie votes in both the House and Senate have been broken. What About Ties in a State’s Popular Vote What would happen if a state’s popular presidential vote ever resulted in a tie? While statistically remote, tie votes are possible particularly in smaller states. In the event a state’s popular vote was to result in an exact tie, a recount is required. Should the vote remain a tie even after the recount, state law governs how the tie is to be broken. Similarly, an extremely close or disputed vote could result in a state run-off election or legal action to decide the winner. Under Federal law at 3 U.S.C. section 5, state law governs and would be conclusive in determining the state’s Electoral College vote. If the state has laws to determine controversies or contests as to the selection of its electors, the state must make that determination at least six days prior to the day the electors meet. Past Election Controversies In the controversial 1800 presidential election, an Electoral College tie vote occurred between Thomas Jefferson and his running mate,  Aaron Burr. The tie-breaking vote made Jefferson president, with Burr declared vice president, as the Constitution required at the time. In 1824, none of the four candidates won the required majority vote in the Electoral College. The House elected  John Quincy Adams president despite the fact that Andrew Jackson had won the popular vote and the most electoral votes. In 1837, none of the vice presidential candidates won a majority in the Electoral College. The Senate vote made Richard Mentor Johnson vice president over Francis Granger. Since then, there have been some very close calls. In 1876, Rutherford B. Hayes defeated Samuel Tilden by a single electoral vote, 185 to 184. And in 2000, George W. Bush defeated Al Gore by 271 to 266 electoral votes in an election that ended in the Supreme Court.

The climate was a little unsure at first because he was new and began with a pretty standard story. As he continued the standard story transitioned Into a very good point and the climate changed to everyone agreeing and accepting his message with open arms. Some might have thought the sermon was a little drawn out; church did get out ten minutes later than usual. Its possible that people who had somewhere to go either intended message.He could have improved the speech by cutting those extra ten minutes out and by doing so keeping everyone happy. Also, he could have started directly with his thesis and then gone into the story instead of beginning with the story, which probably did not interest everyone right away. I learned that practice truly does make perfect, Deacon Bob has years and years of experience and it showed in his execution of getting his strong message across. I realized that the space you give your speech in can have unexpected obstacles, improvising with the space given and making sure everyone feels included is crucial.Keeping everyone interested is probably most vital and this speech taught me that subtle Jokes can increase interest, while also reinforcing the underlying message. I also realized that you dont have to be someone that your audience already knows and likes in order for them to be open to what youre saying. It, in turn, boosted my confidence in myself as a speaker because Deacon Bob was virtually unknown to the entire audience. In future speeches of mine I will try to display more confidence, because I saw such a strong example I know I can do better.Being passionate when peaking can increase interest in your audience as well and in future speeches I will do my best to choose a topic I can put my heart into, not Just see it as an assignment. In 1845, Frederick Douglass published his autobiography, Narrative of the Life of Frederick Douglass, an American Slave.Through writing and word of mouth, Douglass achieved international fame. Despite all of this, the validity of the slave narrative genre has come into question. Skeptics and naysayers claim that this genre of writing is fantasized, and use Olaudah Equiano’s narrative as a prime example. Although The Interesting Narrative of the Life of Olaudah Equiano has questionable history validity; Douglass’ writings have been affirmed by William Lloyd Garrison, a prominent American abolitionist, in the preface.It has also been published and categoriz ed as an autobiography. Accordingly, it is established that Douglass’ writing is non-fiction, therefore, it must be authentic. And then I thought, would he have called a doctor for me? And I kept right on walking(Would 162). Events such as the one depicted in this story occur all to often on our city streets. The fact that some people will kill for thirty-five dollars has many people in this country searching for a legal source of protection. Through a concealed handgun license innocent people can often walk away from potentially violent crimes unharmed. Carrying a concealed handgun makes perfect sense to everyone but criminals (Jones 259). Whose fault is it when innocent people are murdered because they obey the law and do not carry handguns illegally? If those who abide by the law cannot protect themselves, criminals are assured unarmed targets who are strictly at their, the criminals, mercy. In these cases a concealed handgun acts as an equalizer for those overpowered or outnumbered. The department of Justice states that eighty-seven percent of all violent crimes occur outside the home and concealed handguns are the only defense. Maybe Denver talk-show host Alan Berg would still be alive had he not been denied his concealed handgun permit while fearing his death by white supremacists (Snyder 31). Law abiding citizens have nothing to fear from the legalization of concealed handgun permits. Since the first concealed weapons legislation in Florida in 1987, 31 states have legislated concealed weapon laws, and in each state applicants must meet certain criteria before actually being licensed. Rather reliable background checks are done on each applicant revealing any criminal history or mental illness (Ludwig 1). Most states also require that applicants pass a firearms training course and subject a record of fingerprints to local authorities (Snyder 31). As gun control advocates foretold, wild west shootouts and road-rage killings have not resulted from these concealed carry laws. To say the least, gun control advocates have been profoundly embarrassed by the results of these permits. Between 1987 and 1995, 300,000 concealed handgun permits were issued in Florida. Of these, only five permitted handguns were used in violent crimes and no deaths were recorded (Norquist 75). Yes, five out of 300,000 concealed weapons permits were misused. No law is perfect and no matter what laws are passed, people will still have guns and misuse them. These numbers do show, however, that concealed weapons are not the cause of the countrys crime problem. As a whole, concealed weapon carriers do not engage in violent crimes. Criminals do have weapons and do misuse them (Jones). In the United States, the greatest country in the world, citizens enjoy rights people elsewhere can only dream of. Is it not proper that a person also have the right to protect him or herself? Without concealed handgun laws, an average law-abiding citizen does not have the choice of concealed protection (Jones). In most states, the unlicensed carrying of a handgun is punishable by six to twelve months in jail, regardless of circumstances (Ten 23). With laws like this, what is a person to do? Gun control advocates have the answer. In the case of an emergency, call the police. Despite popular belief, courts have ruled that the police cannot be held accountable for the lack of preventing a crime (Jones). Their function is simply to deter crime. According to the Department of Justice, even if police were accountable and every victim readily had access to a phone, only twenty-eight percent of the time can they arrive within five minutes (Norquist 75). Concealed-carry laws allow law abidin g citizens to be responsible for themselves, to protect themselves and their loved ones, and not have their hands tied by laws that arent followed by criminals (Jones). She tells the main character, Terry Mcaleb that his new heart is from her recently murdered sister, Gloria Torres and asks Terry to come out of retirement to find out who murdered her sister.   Ã‚  Ã‚  Ã‚  Ã‚  I really liked this book because it had a very interesting story line with many twists and turns along the way. The story follows Terry in his search for Gloria’s murderer. Along the way he gets many leads such as 2 previous unsolved cases of people murdered in cold blood for no apparent reason. Throughout the book almost all of the leads that were talked about turned out to be useless I found this to be a waste of space. But after the bulk of the book is done Terry makes the connection between the other murders that all of the victims had a rare blood type, the same rare blood type which made it so difficult for him to find a heart for his surgery. After this point the books story starts to pick up again and it all comes together when he finds out that all 3 of the murders were committed by one of the serial killers he never caught as an FBI agent known as the code killer. The code killer killed all of these people specifically so that their organs would b e put up for donation and Terry would get a new heart, the killer wanted him to live because of him. The book comes to a really good ending where all of the loose ends are tied up.   Ã‚  Ã‚  Ã‚  Ã‚  What I did not like about this book was all of the wasted space and time. The book itself had a really good story but could have been told much better. I found that after the problem was stated at the start of the book it all just turned into Terry going after the same useless leads over and over again. The author could have left all of that out of the book and it would have been much more exciting instead of getting the feeling of dragging on until near the end when it picks up again.

When focusing on the past, it won’t give time to let old wounds heal. Other wise someone who uses law heals that wound and moves on to better things. Bacon then goes on to state that the only tolerable revenge is a public one, where there is no law to follow. He uses Caesar’s death as an example, showing that because he had been murdered there was no law because it was more of a dictatorship; therefore there was no solid law in the land that could follow the assignation of him.So when people obtained revenge for Caesar’s death it restored order and law, and therefore there was no law to punish those who got revenge for Caesar’s death because it had restored order. Now the dictator in Carolyn Forcheâ⠂¬â„¢s piece, â€Å"The Colonel†, is not quite the same as Caesar was, he was a bit more on the harsh side. In this very vivid depiction of the Colonel’s house and his surrounding it is shown that he lives in a life of constant threat. From the bars on his windows, to the lights in and around his house it shows the fear that he holds inside.From the glass on the floor and in the wall, to the pistol that remains next to him, to the ears that he keeps in a paper bag it is shown that he lives a life of violence as well. The Colonel is surrounded by all this fear and violence that it seems like that is all he knows. He was obviously previously served his time in the military because he is addressed as the Colonel, and also that violence is the only way to deal with a situation. Many people who serve the military become so engulfed in a vengeful way of doing things that they view that getting revenge and violence is the best way to handle a situation.Now that the Colonel ha s power over his land he resorts to revenge to get his point across to his people and through that justice is established (according to him). Forche reveals that, â€Å"He spilled many human ears on the table. † (Forche ll. 16) showing that when his people aren’t obeying is point of view he gets revenge, a â€Å"wild justice†, to keep is land in order. The Colonel is affirming what Bacon had stated, that revenge is a selfish act and it is done for one’s own profit, pleasure, or honor. The Colonel exclaims, â€Å"As for the rights of your people, tell them they can go fuck themselves,† (ll. 0-21) showing that his anger towards his people. It shows that the Colonel is focusing on his past because he seems to keep using revenge to try and obtain justice for those whom disobey him. The Colonel reveals that he isn’t that much of a wise person because if he were wise then he would not be focusing on things in the future, according to Bacon. So the Colonel, through Bacon’s eyes, is a vengeful person who will never be able to become a wise governing power, instead he dwells on the past and keeps wounds fresh through his acts of revenge.It is seen time and time again that revenge and bringing justice into one’s own hands becomes a spiraling vortex that may never end. If a person takes revenge then that person will most likely receive revenge as well, and this will keep on going back and forth and won’t ever stop. Revenge and Justice are one in the same. Swift states that the problem that affects the society most is overpopulation. In fact, he states that most abortions occur in society because of financial constraints as opposed to moral decadence. He states that poor people give birth to many children whereas they cannot afford to cater for their needs. Through satire, he proposes that poor catholic families of Irish origin should feed and fatten their chi ldren then sell them to wealthy people, the Protestants, who are the land owners. This way they will be able to resolve the predicament of poverty and starving their children. The wealthy Protestants would use those children for their food purposes. Both Swift and Du Bois have problems that they think require a solution that will end those problems once and for all. The problem that Swift wants to solve is poverty and starvation caused by irresponsible births brought about by the poor. Dubois wants to solve the problem of racism that exists between the white population and the black population, in the United States of America. Both Swift and Du Bois offer controversial solutions that favor one group and discriminate on another group, in the same society. Du Bois alludes Swift by offering a similar proposal but on a different case. Despite the fact that Du Boi se does not carry out a mathematical analysis, he analyzes the issues surrounding racism between the whites and blacks, in America. After his analysis, he proposes to the white that the best option is to slaughter blacks. Du Bois similarly proposes that slaughtering the people who are the problem, in the society is the best solution. Swift proposes the children to be slaughtered while Du Bois proposes the blacks to be slaughtered (Du Bois 50). Du Bois also alludes Swift by offering a solution to the problem that affects the people who are powerful or the high class in the society. In swift’s case, the powerful are the wealthy Protestants.
